TERMS AND CONDITIONS

Flicksy - Your Trusted Service Partner

These terms and conditions ("Terms") govern the use of services made available on or through the Flicksy website and/or the Flicksy mobile application (collectively, the "Platform") by Flicksy and its affiliates. By accessing or using the Platform, you agree to be bound by these Terms.

1. SERVICES

1.1 The Services include the provision of the Platform that enables you to arrange and schedule different services including salon services, beauty care, house cleaning, appliance repair, handyman services, and other home-based or service center-based services with independent service professionals ("Service Professionals").

1.2 The services rendered by Service Professionals are referred to as "Professional Services" and may be provided either:

  • At your home/preferred location ("At-Home Services"), or
  • At the Service Professional's location/service center ("Service Center Services")

1.3 The Platform is for your personal and non-commercial use only. You may not use the Platform for any commercial purposes without our prior written consent.

1.4 The Services are made available under the Flicksy brand and may be offered through various channels including the website, mobile application, and partner platforms.

1.5 In certain instances, you may be required to furnish identification proof, address verification, or other documentation as may be required by Flicksy or the Service Professional for service delivery.

1.6 Flicksy acts as an intermediary platform connecting customers with Service Professionals. The actual services are performed by independent Service Professionals.

2. ACCOUNT CREATION

2.1 To avail the Services, you will be required to create an account on the Platform by providing accurate and complete information including your name, mobile number, email address, and other required details.

2.2 You warrant that all information furnished by you is accurate, current, and complete, and you agree to update such information to maintain its accuracy.

2.3 You are solely responsible for maintaining the security and confidentiality of your account credentials, including your password and OTP (One-Time Password).

2.4 You are liable and accountable for all activities that occur under your account. You agree to immediately notify Flicksy of any unauthorized use of your account.

2.5 You agree to receive communications from us regarding your bookings, promotional offers, service updates, and other information related to the Services via SMS, email, WhatsApp, push notifications, or other communication channels.

2.6 You must be at least 18 years of age to create an account and use the Services. By creating an account, you represent and warrant that you meet this age requirement.

3. USER CONTENT

3.1 Our Platform may contain interactive features that allow you to post, submit, publish, or display content including reviews, ratings, feedback, comments, photos, and other materials ("User Content").

3.2 As part of the effective provision of the Services, you may be required to provide certain information, images, or access to your location to enable Service Professionals to deliver services effectively.

3.3 You grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Platform and our business operations.

3.4 In connection with these Terms and the licenses granted herein, you agree and acknowledge that Flicksy may, without notice to you, use, modify, or remove User Content that violates these Terms or is deemed inappropriate.

3.5 You agree and acknowledge that Flicksy may, without notice, monitor, screen, or edit User Content to ensure compliance with these Terms and applicable laws.

3.6 You represent and warrant that you own or have the necessary rights to all User Content you submit and that such content does not violate any third-party rights or applicable laws.

4. CONSENT TO USE DATA

4.1 You agree that we may, in accordance with our Privacy Policy, collect, use, store, and process your personal information including name, contact details, location data, service history, and payment information for providing Services.

4.2 In addition to any consent you may provide pursuant to our Privacy Policy, you agree that Flicksy may contact you via telephone, SMS, email, or other communication methods for service-related communications, promotional offers, and feedback collection.

4.3 Subject to applicable laws, we may be directed by law enforcement agencies or government authorities to disclose your information, and you consent to such disclosure when legally required.

4.4 You consent to the use of your location data to enable service delivery, match you with nearby Service Professionals, and improve service quality.

5. BOOKINGS

5.1 Orders

The Platform permits you to request various Professional Services by selecting the desired service, date, time, and location (home service or service center). You may customize your booking based on available options.

5.2 Confirmation

Once you place a request, we will provide you with a confirmation via the Platform, SMS, or email. The confirmation will include details of the service, assigned Service Professional (if applicable), date, time, and location.

5.3 Cancellations

  • Bookings that are cancelled before the Service Professional arrives or before the scheduled time may be eligible for a full or partial refund as per our Cancellation Policy.
  • Cancellations made after the Service Professional has arrived or within a specified time window before the scheduled service may incur cancellation charges.
  • Flicksy reserves the right to cancel bookings in case of Service Professional unavailability, unforeseen circumstances, or violation of Terms.

5.4 Rescheduling

You may reschedule your booking subject to Service Professional availability and applicable rescheduling policies. Rescheduling requests should be made through the Platform or by contacting customer support.

5.5 Substitution

In case of unavailability of the originally assigned Service Professional, Flicksy may assign an alternate Service Professional with similar qualifications and experience to fulfill your booking.

5.6 Service Location

For At-Home Services, you must ensure the service location is safe, accessible, and suitable for service delivery. For Service Center Services, you agree to visit the specified location at the scheduled time.

6. PRICING AND PAYMENT

6.1 The pricing for Professional Services will be displayed on the Platform at the time of booking. Prices may vary based on service type, location, time, and other factors.

6.2 You agree to pay the total amount displayed at the time of booking confirmation, including service charges, taxes, and any applicable fees.

6.3 Payment may be made through various methods including credit/debit cards, net banking, digital wallets, UPI, or cash (where available).

6.4 All payments are processed securely through our payment gateway partners. Flicksy does not store complete credit/debit card information.

6.5 In certain cases, additional charges may apply for extra services, materials used, or services beyond the original scope, which will be communicated to you before proceeding.

6.6 Prices are subject to change without prior notice. However, once a booking is confirmed, the price will remain as agreed at the time of confirmation.

7. SERVICE DELIVERY

7.1 Service Professionals will make reasonable efforts to arrive at the scheduled time. However, Flicksy does not guarantee exact arrival times due to factors beyond our control.

7.2 For At-Home Services, you must provide a safe, clean, and suitable environment for the Service Professional to perform the services.

7.3 You agree to cooperate with Service Professionals and provide necessary access, information, and materials required for service delivery.

7.4 Service Professionals reserve the right to refuse service if they determine that the environment is unsafe, unsuitable, or if you behave inappropriately.

7.5 For beauty and salon services, you may be required to conduct a patch test prior to certain treatments to check for allergic reactions.

7.6 Any specific requirements, preferences, or instructions should be communicated to the Service Professional at the time of booking or before service commencement.

8. QUALITY AND WARRANTIES

8.1 Flicksy strives to connect you with qualified and experienced Service Professionals. However, as an intermediary platform, Flicksy does not directly provide the Professional Services.

8.2 Service Professionals are independent contractors and are responsible for the quality and outcome of services rendered.

8.3 Flicksy does not provide any warranties or guarantees regarding the quality, accuracy, or results of Professional Services, except as may be explicitly stated in specific service offerings.

8.4 If you are dissatisfied with the service quality, you may report the issue through the Platform or customer support for resolution.

8.5 Flicksy may offer service guarantees or quality commitments for specific services, which will be communicated to you at the time of booking.

9. USER RESPONSIBILITIES

9.1 You agree to provide accurate information about your service requirements and any relevant health conditions, allergies, or concerns.

9.2 You agree to behave courteously and respectfully with Service Professionals and refrain from any harassment, abuse, or inappropriate conduct.

9.3 You are responsible for securing your valuables and belongings during service delivery.

9.4 For At-Home Services, you agree to ensure that children and pets are kept safe and away from the service area if required.

9.5 You agree not to directly hire or engage Service Professionals found through the Platform for services outside the Platform without Flicksy's consent.

9.6 You agree to provide honest and fair reviews and ratings based on your actual experience with the service.

10. PROHIBITED CONDUCT

You agree not to:

  • 10.1 Use the Platform for any unlawful purpose or in violation of these Terms.
  • 10.2 Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
  • 10.3 Interfere with or disrupt the Platform or servers or networks connected to the Platform.
  • 10.4 Attempt to gain unauthorized access to any portion of the Platform or any systems or networks.
  • 10.5 Use the Platform to transmit any harmful, threatening, abusive, defamatory, or otherwise objectionable content.
  • 10.6 Engage in any activity that could damage, disable, or impair the Platform's functionality.
  • 10.7 Reproduce, duplicate, copy, sell, or exploit any portion of the Platform without express written permission from Flicksy.

11. INTELLECTUAL PROPERTY

11.1 All content on the Platform, including text, graphics, logos, images, software, and other materials, is the property of Flicksy or its licensors and is protected by intellectual property laws.

11.2 The Flicksy name, logo, and all related trademarks, service marks, and trade names are proprietary to Flicksy.

11.3 You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal purposes in accordance with these Terms.

11.4 You may not use, reproduce, or distribute any content from the Platform without prior written permission from Flicksy.

12. LIMITATION OF LIABILITY

12.1 To the maximum extent permitted by law, Flicksy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform or Services.

12.2 Flicksy's total liability for any claims arising out of or relating to these Terms or the Services shall not exceed the amount paid by you for the specific service giving rise to the claim.

12.3 Flicksy is not liable for any damages, losses, or injuries caused by Service Professionals during service delivery, except to the extent required by law.

12.4 Flicksy is not responsible for any delays, failures, or interruptions in service delivery due to circumstances beyond our reasonable control.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Flicksy, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or relating to:

  • 13.1 Your violation of these Terms
  • 13.2 Your use of the Platform or Services
  • 13.3 Your User Content
  • 13.4 Your violation of any third-party rights
  • 13.5 Your conduct in connection with the Services

14. DISPUTE RESOLUTION

14.1 Any disputes arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good faith negotiations.

14.2 If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the applicable arbitration laws.

14.3 The arbitration shall be conducted in English and the seat of arbitration shall be [Your City/Location].

14.4 Each party shall bear its own costs related to arbitration unless otherwise determined by the arbitrator.

15. TERMINATION

15.1 Flicksy may suspend or terminate your account and access to the Platform at any time, with or without notice, for violation of these Terms or any other reason.

15.2 You may terminate your account at any time by contacting customer support or through the account settings on the Platform.

15.3 Upon termination, your right to use the Platform will immediately cease, but provisions that by their nature should survive termination shall remain in effect.

15.4 Flicksy is not liable to you or any third party for any termination of your access to the Platform.

16. MODIFICATIONS TO TERMS

16.1 Flicksy reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform or through other communication channels.

16.2 Your continued use of the Platform after the effective date of modified Terms constitutes your acceptance of the changes.

16.3 It is your responsibility to review the Terms periodically for any updates or modifications.

17. GENERAL PROVISIONS

17.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of India.

17.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3 Waiver: No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

17.4 Entire Agreement: These Terms, together with our Privacy Policy and other policies, constitute the entire agreement between you and Flicksy.

17.5 Assignment: You may not assign or transfer these Terms without our prior written consent. Flicksy may assign these Terms without restriction.

17.6 Force Majeure: Flicksy shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control.
